Federal Judge Blocks Temporary Ban on US Work Visas

A federal judge of the U.S. District Court for the Northern District of California, Jeffrey S. White, ruled that President Donald Trump went over his authority in suspending visas for thousands of foreign workers during the COVID-19 pandemic. 

The ruling now allows major companies such as Microsoft, Exxon Mobil, and Goodyear Tire to resume allowing employees to relocate to the U.S. from abroad. Thousands of businesses have been trying to bring H-1B highly-skilled employees, seasonal workers on guest-worker visas, and others to work in the United States at their companies.

The judge claimed the delegation of authority from Congress about the U.S. immigration context does not allow President Trump unlimited authority to set domestic policy in reference to the employment of nonimmigrant workers. President Trump said his decree was to protect U.S. citizens from foreign competition during the coronavirus pandemic. In the proclamation by Trump, he said the entry of additional laborers under the work visas was an “unusual threat to the employment of American workers.” The Trump proclamation restricted companies’ facilities in the United States with worldwide operations and global companies with U.S. branches to transfer employees and foreign executives to the U.S. for extended periods.
